The legal process of probating refers generally to the legal steps an executor takes to solve a deceased person's estate. This involves proving the validity or distributing assets using the rules for intestacy, if there is none.

Is Probate Necessary?

Probate assets are usually solely owned by the deceased. There is no beneficiary designation that allows them to pass to someone else by law. This includes solely owned homes, bank accounts, individual bank accounts, and cars.

Assets that are not subject to probate include:

Assets in trust

Bank accounts with a named beneficiary

Retirement accounts like a retirement account and a 401k

Probate is not required if:

The estate is small. A small estate or voluntary administration proceeding in New York is an alternative to probate. This happens if the deceased had less than $30,000 in personal property, with or without a will.

There are no probate properties. The probate process is not necessary if an estate is made up only of non-probate assets.

The estate plan was made to avoid probate. Estate planning is often a solution for people with high net worth who want to make it easier to distribute their assets to their heirs.

What is the Probate Procedure?

Probate is a complex process that involves many steps.

Filing the probate petition. The executor must file a certified copy and the original will together with the probate petition. A filing fee is charged based on the estate's value.

Give notice. Mail a Notice to All Creditors, Beneficiaries, and Heirs.

You must pay any outstanding debts or taxes. This includes mortgage payments and home equity loans. Assets that are not sufficient to pay obligations may have to be liquidated if there isn't enough cash.

As the will or state probate law directs, the remainder property should be distributed. The initial probate petition lists the distributees, which is the legal term for the heirs. A notice, also called a "citation", is sent to them. Do I need a Probate Attorney to represent me?

It is not always possible to finish the probate process in the required time. If all heirs are found, the will does not need to be contested, appraisals are not required and the debts are resolved quickly, probate can usually be completed within three to six month. Probate may take several years for more complex cases, especially those that are contested.

New York law does not require a probate lawyer. However, legal help can be a time-saver by making sure that the paperwork is correct and all those who have an interest in it are notified. To resolve a dispute in the will, an executor can be assisted by a probate lawyer who has experience in estate litigation and New York State civil practices rules.

It can be very detrimental to your health. It is impossible to avoid it all, but there are ways you can reduce the effects. Do not take on too many responsibilities. Set limits for yourself and others. It is okay to say no.

You can prevent problems from coming your way tomorrow if you make the right decisions today.


Brush your teeth twice daily and floss each day.

Don't smoke.

Limit your alcohol. Limit your alcohol intake to 1 drink per day.

Take your medication exactly as prescribed by your doctor.

Get better sleep. Try to sleep for at least 8 hours. Talk to your doctor if you are having trouble sleeping.

Keep out of direct sunlight between 10 a.m. and 3 p.m.

Wear your seatbelt.

Meng suggests that you take time each day to invest in your own health.


Montgomery was able to see the benefits. Montgomery says that she has overcome health issues, is happy, and has a positive outlook. She says that her life has been forever transformed.
